THIS AGREEMENT (“Agreement”) is entered into by and between the undersigned participant (“Participant”) and Adventure Palace (“Company”).

In consideration of being allowed to participate in any riding or non-riding activities offered by Adventure Palace (the “Activity”), I, on behalf of myself, my personal representatives, assigns, and heirs, agree to the following:

1. Acknowledgment of Understanding

I acknowledge, agree, and represent that I fully understand the nature of the Activity, which includes, but is not limited to, riding and engaging in Indoor Jungle Gym and Rope Course. I affirm that I am qualified, in good health, and physically capable of participating. I further understand that portions of the Activity may take place on tall areas, which involve inherent risks. I agree that if at any point I believe conditions are unsafe, I will immediately stop participating.

2. Assumption of Risk

I fully understand and agree that:

• The Activity involves risks and dangers that may result in serious bodily injury, permanent disability, paralysis, or death (“Risks”).
• These Risks may arise from my own actions or inactions, the actions or inactions of other participants or non-participants, environmental conditions, or the negligence of the Releases defined below.
• Additional risks may exist that are unknown or not reasonably foreseeable at this time. I willingly accept and assume all such risks and all responsibility for any resulting losses, costs, or damages connected to my participation or that of a minor in the Activity. By participating, I acknowledge the inherent dangers associated with riding and using the Indoor Playground and arcade.

3. Release and Waiver of Liability

I hereby release, discharge, and agree not to sue Adventure Palace, along with its administrators, directors, officers, agents, successors, assigns, members, ride leaders (if applicable), volunteers, employees, participants, sponsors, advertisers, and owners or lessors of premises used for the Activity (collectively, the “Releases”), for any liability, claims, demands, losses, or damages arising from my participation, whether caused in whole or in part by the negligence of the Releases or otherwise, including negligent rescue efforts.

If I or anyone acting on my behalf brings a claim against any of the Releases despite this Agreement, I agree to indemnify and hold harmless all Releases from all litigation expenses, attorney fees, losses, liabilities, damages, or costs incurred as a result. I further agree to indemnify and hold harmless Adventure Palace and all Releases from any claims including those involving negligence, unintentional conduct, or omissions arising from my involvement in any Activity.

4. Indoor Playground and Arcade Risks for Minors

I understand that participation in the Jungle Gym and Rope Course involves specific risks, including falls, collisions, and possible equipment or structural failures. If the Participant is a minor, I, as the minor’s legal guardian, acknowledge and accept these risks on the minor’s behalf. I assume full responsibility for these risks and release and hold harmless the Releases from any claims arising from the minor’s participation.

5. Participation of Children With Special Needs

If the Participant is a child with special needs, I, as the legal guardian, acknowledge the unique risks associated with the Activity. I agree to inform Adventure Palace of any accommodations or support the child may require. I further understand that although Adventure Palace will make reasonable efforts to provide a safe environment, inherent risks still exist, including risks specific to children with special needs. I hereby release and hold harmless the Releases from any claims connected to the minor’s participation, including those involving the adequacy or absence of accommodations.

6. Personal Responsibility

I understand that I am responsible for my own behavior and choices during any Adventure Palace Activity. I agree that this Waiver & Release applies to any claim arising from my participation in both riding and non-riding activities associated with any Event.

7. Parent and Legal Guardian Waiver for Minors (Under 18 Years of Age)

If this Agreement applies to a minor Participant, I, the undersigned parent or legal guardian, affirm that I am legally authorized to act on the minor’s behalf.
I understand the nature of the Activities, have reviewed the minor’s abilities, and believe the minor is qualified, in good health, and capable of participating. I release, discharge, and agree not to sue the Releases for any claims arising from the minor’s participation, including claims caused in whole or in part by the Releases’ negligence or negligent rescue efforts. If I, the minor, or anyone acting on the minor’s behalf brings a claim contrary to this Agreement, I agree to indemnify and hold harmless all Releases from all litigation expenses, attorney fees, losses, liabilities, damages, or costs resulting from such claim.
